Introduction:
These Terms of Use (“Terms”) govern the use of the getbikenow.com, a brand within Sigma CloudForge LLC ( "GBN" “us”, “we”, or “our”) services, including the https://getbikenow.com and https://supplier.getbikenow.com websites (the “Service”), applications, themes, and other related offerings.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, please do not access the Service.

By using the Service, you represent and warrant that you meet all the requirements listed above and will not use the Service in violation of any laws or regulations.
GBN reserves the right to refuse service, close accounts, and change eligibility requirements at any time in order to protect its own, and the interest of customer and suppliers.
Payments, fees, cancellations and refunds:
Certain parts of the Service are billable (“Payments”). You will be billed in advance on a one-time basis (“Billing Period”). Additional charges may apply depending on the chosen bike rental such as optional activities, food or drinks and similar which needs to be discussed directly with the supplier during the activity.
GBN reserves the right to refuse to provide service at any time, with an obligation to provide timely notice (3-15 hrs). You may cancel your payment and reservation through your bookings page or by contacting the GBN team.
Depending on the specific offering, customer may be eligible for a full refund in case of cancellation by customer more than 24 hours before the activity start.
Customer may also ask for a partial refund within 24 hours after the activity has ended in case they believe they didn’t receive the service as described in the offering. This should be first discussed with the supplier over the getbikenow.com communication channel (contact customer/supplier option on the booking details page). If the issue cannot be resolved then office@getbikenow.com needs to be contacted to help find the solution.
In case that the supplier cancels or rejects a booking at any time before the activity start, customer will automatically receive a full refund.
A valid payment method (credit card, debit card, or PayPal) is required. You shall provide accurate billing information.
Friend referral program:
GBN offers a way for users to earn money by referring it to friends. Each new user will get an automatically generated referral code upon 48 hours after account registration is completed, which can be sent to their friends. Each referrer and referee have benefits from using the referral code in terms of credits earned. Referral cashback will be paid 48 hours after the bike rental has been finished – because in that period users can ask for a refund. If the refund has been issued then referral cashback will not be automatically paid out. Earned credits don't have to be cashed out, they can also be used for booking new bike rentals.
Fee and Fee Changes:
GBN charges an advertising fee to suppliers which is paid only in case of booking. GBN will process the booking, deduct it’s fee and send the rest of the purchase value to supplier. Supplier payouts happen in the first week of the month and contain all earnings from the previous month.
GBN, at its sole discretion, may modify Payment or Cancellation fees for bike rentals, with changes becoming effective immediately. GBN will provide reasonable prior notice of any fee changes.
Your continued use of the Service after fee modifications constitutes agreement to pay the modified fee amount.
Authorized Use of the Service:
Users may only use the Service for lawful purposes consistent with its nature and purpose. Unauthorized use may result in criminal charges and/or a claim for damages.
Both suppliers and customers are obliged to provide only accurate information about themselves, activities and potential hazards in order to ensure everyone’s safety during the activities.
Limited Responsibility Clause:
GBN discourages unauthorized use of copyright-protected content. GBN is not responsible for damages resulting from unauthorized use, with responsibility lying on the party publishing such content - suppliers in case of publishing their listings. GBN will act in accordance with applicable laws, including content removal and account termination for copyright violations.
GBN will also use all of it’s capacity to validate the offerings and content in order to prevent any sort of illegal activities. However, GBN is not to be held responsible for inaccurate content uploaded by suppliers such as bicycle descriptions, photos and other related information, as well as for the failure of customers to provide the suppliers with proper information regarding their riding skills, physical abilities and general health conditions.
Suppliers are obliged to take maximum precautions to ensure high quality of service and safety of all participants and their property during the activities / bike rentals sold via getbikenow.com.
Suppliers are obliged to to keep the bicycles well maintained and safe to use.
Suppliers are obliged to handle the insurance for their bicycles and other property, GBN is not responsible for loss of any of the equipment rented to GBN customers.
Accounts:
When signing up, provide accurate and current information. Failure to do so constitutes a breach of the Terms, resulting in account termination. Users are responsible for safeguarding their passwords and notifying GBN of any security breaches.
Intellectual Property on the Service:
The Service's content, features, and functionality are the exclusive property of GBN and its licensors, protected by copyright. Users do not acquire ownership rights and must not use the content without permission.
Links to Other Websites:
GBN is not responsible for third-party websites, such as Google and Paypal services, linked in the Service. Users should read the terms of use and privacy policies of these websites.
Data Protection:
Information about users and posted content will be collected, held, and used by GBN in accordance with its Privacy Policy.
Termination:
GBN may terminate or suspend accounts without prior notice for any reason, including breach of the Terms. Users can terminate use by discontinuing the Service and notifying GBN.
Limitation of Liability:
In no event shall GBN, its directors, employees, partners, agents, suppliers, or affiliates be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses.
Disclaimer:
The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied. GBN makes no guarantees regarding success or course of performance.
Governing Law:
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United States.
All disputes between GBN and you (whether or not such dispute involves a third party) shall be submitted exclusively to the competent court of law in a jurisdiction determined by GBN within the United States or Europe.
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms shall remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Changes:
GBN reserves the right to modify these Terms at any time. Users agree to be bound by the revised terms by continuing to access or use the Service.
Partial Invalidity:
If any provision of the Terms becomes illegal, invalid, or unenforceable, it will not affect the legality, validity, or enforceability of the remaining provisions.
